The rules of the road, written like a human.

You must be at least eighteen (18) years of age and able to form a binding contract under the laws of your jurisdiction. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

OurBaby is an entertainment tool. You upload two facial photographs and the Service generates a series of synthetic portrait images depicting a plausible-looking child composed from the visible features of the two inputs, progressed across five illustrative life stages.

The Service is not a medical, genetic, diagnostic, or genealogical tool. Its outputs are AI projections, not predictions, and have no scientific value for family planning, paternity, parentage, fertility, health, or related determinations. You agree not to rely on the Service for any of those purposes.

You may only upload photographs (a) of yourself, or (b) of an adult who has given you their explicit, freely given, informed permission to upload their face for this purpose. By submitting a photograph, you represent and warrant that you hold the necessary rights and consents.

You retain ownership of your photographs. You grant OurBaby a limited, worldwide, royalty-free, non-exclusive license to process them for the sole purpose of generating, storing (for the retention period described in the Privacy Policy), displaying, and delivering the reveal you requested. This license terminates automatically when the photographs are deleted from our active systems.

You may not upload photographs of minors (people under the age of eighteen), of individuals known or believed to be deceased, of public figures or celebrities without their explicit consent, or of any person whose likeness you do not have the right to submit.

We assign you a non-exclusive, perpetual, worldwide license to use, download, reproduce, and share the generated images for personal, non-commercial purposes. You may not (a) use the images to misrepresent the identity of any real person, (b) present the images as authentic photographs of a real child, (c) use the images to harass, harm, defame, or intimidate anyone, or (d) train, tune, or evaluate any machine-learning model on the images without our prior written consent.

Commercial use (including resale, syndication, paid licensing, or use in advertising for products other than OurBaby itself) requires a separate license. Contact legal@ourbaby.app to discuss.

The Service offers a free first reveal and paid unlocks (collectively, “Paid Features”). Prices are displayed on the Service in United States dollars unless otherwise indicated. We may modify prices for future purchases; existing one-time purchases retain their original price.

One-time purchases (such as the Pro Pack, Storyline pack, or other PPV bundles) are charged immediately upon checkout. Subscription products (such as Unlimited) renew automatically at the interval shown at checkout, and you may cancel at any time from your account; cancellation takes effect at the end of the current paid period.

We offer a seven (7) day refund window from the date of the original purchase, for any one-time purchase, no questions asked. Reply to your receipt email or write to legal@ourbaby.app to request a refund.

You agree not to:

• Use the Service for unlawful, fraudulent, or deceptive purposes.
• Upload photographs you do not have the right to submit.
• Attempt to identify, dox, harass, or harm anyone using the Service or its outputs.
• Reverse engineer, scrape, decompile, or otherwise probe the Service for vulnerabilities, except as required by applicable law.
• Use the Service to build, train, or augment a competing AI model, image-generation pipeline, or dataset.
• Bypass paid features, rate limits, or content filters.

We may, at our discretion, suspend or terminate any account that violates these rules, without refund, and may report violations to law enforcement.

We may suspend or terminate access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law. Upon termination, your right to use the Service ends immediately, but Sections 3 through 12 survive.

You may stop using the Service and request deletion of your data at any time by writing to privacy@ourbaby.app.

The Service and all outputs are provided “as is” and “as available” without warranty of any kind, express, implied, or statutory. To the maximum extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, and accuracy. We do not warrant that the Service will be uninterrupted, error-free, or that the outputs will match any particular expectation.

To the maximum extent permitted by law, OurBaby and its affiliates, officers, members, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, use, or goodwill, arising out of or in connection with the Service or these Terms, regardless of the theory of liability and whether or not we have been advised of the possibility of such damages.

In all cases, our aggregate liability arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid to OurBaby in the twelve (12) months preceding the claim, or (b) one hundred United States dollars (US $100).

You agree to defend, indemnify, and hold harmless OurBaby LLC and its affiliates, officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Service, (b) your photographs or other content you submit, (c) your violation of these Terms, or (d) your violation of any third-party right, including the privacy or publicity rights of any person whose photograph you upload.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. The exclusive venue for any action that is not subject to the arbitration agreement below shall be the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of those courts.

Informal resolution. Before filing any claim, you agree to write to legal@ourbaby.app describing the dispute and to give us thirty (30) days to attempt a resolution.

Arbitration. If the dispute is not resolved informally, you and OurBaby agree to resolve the dispute through final and binding arbitration, on an individual basis, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in English, and the seat shall be Sheridan County, Wyoming (or a location mutually agreed upon, including a virtual hearing).

Class waiver. You and OurBaby each waive any right to participate in a class, collective, or representative action against the other.

Opt-out. You may opt out of the arbitration agreement and class waiver above by sending written notice to legal@ourbaby.app within thirty (30) days of first accepting these Terms.

Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and OurBaby regarding the Service, superseding any prior agreements.

Severability. If any provision is held unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will remain in effect.

No waiver. Our failure to enforce any right is not a waiver of that right.

Assignment. You may not assign these Terms without our written consent. We may assign these Terms freely.

Changes. We may update these Terms from time to time. The “Effective” date reflects the most recent revision. Material changes will be communicated to active users at least thirty (30) days in advance by email.
